The CHOOSE Act, in short

The CHOOSE Act (Act 2024-21) funds education savings accounts (ESAs) through a refundable state income-tax credit. The Alabama Department of Revenue (ALDOR) runs it. Families apply on FACTS, and the money moves through ClassWallet.

What CHOOSE Act schools keep up with

From ALDOR’s rule for education service providers, the 2026-27 provider guide and the Code of Alabama. Check ALDOR before you rely on any of it.

  • Getting approved

Apply to ALDOR as an education service provider at any time of year. ALDOR sends its decision within 14 days; then you register with ClassWallet.

  • Accreditation

Be accredited, or in the process, shown by a letter on the accrediting agency’s letterhead signed by its executive officer or an authorized signatory.

  • Financial safeguard

Show financial statements ALDOR accepts, or file a surety bond equal to the CHOOSE funds the school expects that academic year.

  • Withdrawals

Tell ALDOR within 10 business days when a CHOOSE student graduates, withdraws or is no longer enrolled.

  • Testing

CHOOSE students take a standardized, norm-referenced or aptitude test at least once a year, and parents get the results. A special-needs student for whom testing isn’t appropriate can be exempt, with the reason documented. School-level results go to ALDOR, but not when fewer than 20 CHOOSE students are enrolled.

  • Invoices

Invoices may not mention the CHOOSE Act or ClassWallet in any form. More than one student on an invoice? List each student’s charges separately. Only services in the current academic year are approved.

  • Refunds and pricing

Refunds go back to the ESA, never to the parent or student. CHOOSE families can’t be charged higher tuition or fees.
